Last week, we issued an opinion on the county assessor's ability to enter onto private property, without permission, in order to assess the value of a home. The bottom line: We don't think that they can. Nebraskans enjoy strong private property rights which allow them to control who goes on their property; and the Legislature, which has exempted other county officials from the criminal trespass statutes, has never exempted assessors.
